David Zimmerman, aged 77, finds himself entangled in legal proceedings as he faces a slew of charges for allegedly performing dental procedures without the required credentials. The Ministry of Health has leveled a total of 13 charges against Zimmerman for engaging in restricted activities, despite the cancellation of his registration with the Dental Council back in 2017.

These procedures purportedly included tooth extractions, fillings, orthodontic prosthetics, as well as taking moulds and X-rays—activities strictly regulated under the Health Practitioners Competence Assurance (Restricted Activities) Order 2005.
Additionally, Zimmerman and his business, TMJ and Sleep Therapy Centre, face charges related to the unauthorized use of a radiation source, specifically an X-ray machine, on patients, a violation of the Radiation Safety Act. Moreover, Zimmerman is alleged to have falsely presented himself as a registered dentist, with his Whangaparāoa Peninsula residence serving as the backdrop for these illicit dental operations, complete with a sign reading “Dentist open,” misleading patients into believing he held the necessary qualifications.
The legal repercussions for such infractions are significant, with fines of up to $30,000 applicable for unauthorized dental work and up to $100,000 for breaches of the Radiation Safety Act. Phil Knipe, chief legal advisor for the Ministry of Health, emphasized the importance of verifying the registration status of dental practitioners through the Dental Council website to ensure compliance and safeguard patient welfare.
Zimmerman’s troubles with regulatory authorities date back to 2017 when his dental registration was revoked following persistent complaints regarding his professional competence. Despite facing suspension, Zimmerman allegedly continued to practice, ultimately leading to the cancellation of his registration—a precursor to the current legal proceedings.
